Amazon denial of service attack this evening – quick summary of the law

There I was doing a little bit of shopping and it’s all game over.  Looking at the Twittersphere it’s looking like a denial of service attack.  So here’s the law …

Section 3 Computer Misuse Act: an offence to carry out – with intent – an unauthorised act in relation to a computer (that covers denial of service, which of course the old pre amended CMA didn’t, as it used to refer to unauthorised modification of a computer)

Section 3A: an offence to make, adapt, supply or offer to supply any article intending it to be used to commit the above (an article can be electronic, e.g. programs to undertake a denial of service for download)

Under the Serious Crime Act it is separately an offence to undertake an act capable of encouraging or assiting the commission of an offence – as long as the person intends to encourage it and believes that by encouraging it it will be committed.  (So, could bite on Anonymous.)

Being convicted of this stuff could mean prison or a fine, or both (and the prison terms are not insignificant: a serious denial of service attack could mean years in jail.)

You’ve made your point now Anonymous and chums – let us shop or you’ll lose a lot of supporters that you probably didn’t realise you had.  Don’t turn democracy against you.
